The Superior Court of Pennsylvania has awarded a woman $15 million after receiving a pelvic mesh. The mesh, like many others, was defective. It deteriorated after only two months. She was promised that the mesh would help her urinary incontinence. Unfortunately, this mesh made matters worse. The mesh was causing her great amounts of pain. Mrs. Margaret Engleman had to undergo three separate surgeries to remove only some of the mesh. Portions of the mesh have been impossible to retrieve, causing the women chronic pain and urinary dysfunction.
The makers of the mesh shouldn’t surprise anyone. Johnson and Johnson have been hit with thousands of suits over their pelvic mesh, and their role in the opioid crisis. Ethicon, the subsidiary of Johnson and Johnson responsible for the mesh claims no wrongdoing. They claim that the plaintiff failed to show proof that J&J didn’t warn surgeons of the risk the mesh may pose. Luckily, the jury didn’t buy this argument. They awarded the plaintiff over $20 million. However, thanks to the states limit on punitive damages, the total amount awarded was reduced to $15 million.
