Who can file a wrongful death lawsuit?

A representative of the estate of the deceased person usually files the unlawful death suit for the victim’s family and loved ones. Eligible parties vary from state to state. Every state allows the person’s spouse to initiate the lawsuit. Parents can also do this if their child was wrongfully killed, and children can also receive payment for their parent’s death.

The challenge comes in when it comes to adult children, adult siblings, cousins, the parents of adult children, uncles, aunts or grandparents are allowed to file a lawsuit. But depending on the state, if you can prove you were financially dependent on the person who passed away, then you have to right to sue.
