Yesterday, 7/15/2019, A federal Judge lowered the damages a jury awarded a man who developed cancer after using Roundup weed killer. The original amount awarded to the Californa man was $80.27 million dollars. The judge set the new amount to 25.7 million while refusing the company’s appeal for a new trial. Judge Chhabria claims that while Bayer, the former Monsanto company, acted irresponsibly, it did not warrant a ratio in which the punitive damages were more than seventeen times more than the compensatory damages award. The judge went on to say that the amount was “constitutionally impermissible.”
The plaintiff claimed that he used Roundup Weedkiller since the 1980s to kill weeds in his yard. In 2014, the man received the news that he had developed non-Hodgkin’s lymphoma in 2014. Hardeman (the plaintiff) is now in remission. Bayer said in a statement that the judge’s decision was a “step in the right direction.” However, they still plan on repealing instead of paying the damages owed to the plaintiff. Plaintiffs lawyer disagrees with any reduction in the jury’s verdict. However, the Supreme Court precedents limit the ratio of punitive damages to compensatory to 9 to 1.
