Mother Awarded $5.7M in Death of 12-Year-Old Son

wrongful death

Last Wednesday, a mother in Fresno, California won $5.7 million after a settlement with her apartment complex. Victoria Antunez was devastated after her son died in from accidental electrocution. Adrain Perez was playing football outside of his apartment complex last year when the ball fell between a chainlink fence. When he went to retrieve the ball, the 12-year-old was jolted with electricity. The fence was electrified from a live wire that was exposed near the fence. The apartment complex was installing a new surveillance system, which involved electrical wiring. The man hired to do the work was not a certified electrition.  The complex also failed to get the proper permits to begin this kind of work.

When paramedics came, they found Adrain Perez unconscious by the fence. He died a few days later.  Adrain’s mother alleges negligence on the part of the apartment complex, and the company responsible for managing the property. The court case was scheduled for late September, but the parties settled outside of court for $5.7 million last Wednesday. While this is a horrible accident, the family affected hopes this will serve as a reminder to apartment complexes to follow city codes, so nothing like this will happen again.

Wrongful Death Litigation

A wrongful death claim is substantially different than a normal personal injury case. Due to the complexities surrounding the burden of proof, it is important to have an attorney that is experienced with navigating the case law that is required to successfully present a case. Whereas with a personal injury case, the soft records of the injury can be used to provide documentation of the damages, in a wrongful death claim that type of documentation is not as easy to obtain. Having an attorney that can fight for the appropriate amount of compensation to assist the living beneficiaries with life after the person’s death is something that takes skill, compassion, and knowledge of the law.
