It turns out states and individuals are not the only ones suing opioid manufacturers. On Monday, major drug makers lost a bid to kill a RICO suit brought against them. Tucson Medical Center in Arizona is blaming the drug companies for financial harm. They claim they suffered this burden due to the opioid crisis. Over two dozen companies are defendants in the suit, including Purdue and Johnson and Johnson. According to the judge, the hospital has shown plenty of proof that they suffered financial burdens due to the opioid crisis. At least enough to let the case move forward. The hospital filed the case last year. They alleged violations of the Racketeer Influenced and Corrupt Organizations Act and state-specific consumer protection laws. On top of this, they also accuse the companies of public nuisance, fraud, negligence, and unjust enrichment.
The drug companies have tried twice to move the case from federal court, with no success. As of now, the hospital claims that it can prove over $102 in damages. If won, that would make it one of the biggest wins against the major opioid manufacturers. In a statement, representatives from the hospital said: “We believe it is appropriate, both in light of the defendant’s conduct and the widespread impact of the opioid crisis on Tucson Medical Center and the Tucson community.”
